Do you need to apostille a Special Power of Attorney (SPA) for the Philippines?

On May 14, 2019, the Philippines joined the Hague Apostille Convention.  Documents destined for the Philippines no longer requires the red ribbon or red seal from the Philippines Embassy or Consulate office.  The apostille issued by the Secretary of State is sufficient for the special power of attorney to be accepted in the Philippines.

A special power of attorney is a legal document appointing a specific representative (to be called an agent or attorney-in-fact) to act on behalf of another person who will be referred to as the principal.  The special power of attorney authorizes your agent/attorney in fact to do specific acts and functions for you in the Philippines.

In order to apostille the special power of attorney, it must first be signed and notarized.  Please meet with a local notary public before you mail in your documents for processing.

When you book an appointment, choose the service “Legalization/Notarial”

You would need to bring the following:

  • Two (2) copies of the unsigned document;
  • Two (2) original Government-issued Identification Documents (IDs), showing full name, photo, and signature of the applicant;
  • Two (2) photocopies of IDs for every document to be legalized; and
  • Processing Fee of US$25.00 per document (not per page)

I have the following documents: Special power of attorney and Deed of extra-judicial settlement and partition of estate
These documents were notarized in the states. The BIR in the Phillipines said that they need a Red Ribbon. Are these required for the documents? Please point me to what is being requested. Thank you!

Can US power of attorney be used in the Philippines?

For example, if you are in California, all you need to do is meet with a local notary public and mail in the power of attorney with our California apostille order forms for processing.
